Commiserations. Obviously you know what happened, but on my first
reading it didn't look that cut and dry until I got to your description
of the road. I once had an accident when a car I was overtaking turned
right without indicating or checking her mirrors. But then this was on a
wide country road and the other driver admitted fault (until the police
had gone and she went home and started filling in her insurance form,
whereupon she changed her mind!).

I sincerley hope the insurance decide in my favour otherwise i will lose
total faith in the system.


To play devil's advocate, they're going to ask why you didn't see him in
your mirrors before turning. And did you signal? He will no doubt claim
that you didn't.

Depressed now but proud i kept my temper, shouting in my face trying to say
i was going to do a u-turn, pah, 5m (16ft) long car on a narrow road with
cars parked both sides (a two-laner becoming a one laner at this point and
so with a no-go zone in the middle) some chance couldn't turn a KA in there.


He thought you were about to do a U-turn but overtook anyway? Doh!
Your description of the road will be critical. I'd suggest you take a
few photos to put in with your claim. You have to convince them that it
is a totally unsuitable place to overtake.
